COVID-19 DISCLOSURE AND ASSUMPTION OF THE RISK:
Coronavirus Disease 2019 (COVID-19) has been declared a worldwide pandemic by the World Health Organization and U.S. Centers for Disease Control and Prevention. COVID-19 spreads easily and is believed to spread in similar ways to influenza which may include: spreading through the air by coughing and sneezing; close personal contact, such as touching or shaking hands; and touching an object or surface with the virus on it, then touching your mouth, nose, or eyes. Spread is more likely when people are in close contact with one another (within 6 feet). As a result, federal, state and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
The owners and managers of Beach Vacations have put into place certain preventative measures to reduce the spread of COVID-19; however, Beach Vacations cannot guarantee that you, and the other members of your party (including minor children), will not become infected with COVID-19. Further, occupancy at any Beach Vacations property and the enjoyment of common areas and amenities could increase your risk and those in your party of contracting COVID-19.
BY CONFIRMING YOUR RESERVATION AND OCCUPYING A CONDO RENTAL THROUGH THE LITCHFIELD COMPANY, YOU (ON BEHALF OF YOURSELF AND ALL MEMBERS OF YOUR PARTY, INCLUDING, WITHOUT LIMITATION, ALL MINOR CHILDREN), EXPRESSLY ACKNOWLEDGE AND AGREE THAT: (A) COVID-19 IS A CONTAGIOUS AND COMMUNICABLE DISEASE AND ALL MEMBERS OF YOUR PARTY VOLUNTARILY ASSUME THE RISK THAT YOU (AND ALL MEMBERS OF YOUR PARTY, INCLUDING MINOR CHILDREN) MAY BE EXPOSED TO, OR INFECTED BY, COVID-19 AS A RESULT OF OCCUPYING A CONDO RENTAL THROUGH THE LITCHFIELD COMPANY; (B) ANY SUCH EXPOSURE OR INFECTION MAY RESULT IN PERSONAL INJURY, ILLNESS, PERMANENT DISABILITY, AND/OR DEATH; AND (C) ALL MEMBERS OF YOUR PARTY HAVE BEEN, OR WILL BE, INFORMED OF THESE EXPOSURE AND CONTRACTION RISKS BY YOU AND THAT BY VIRTUE OF THEIR OCCUPANCY OF A CONDO RENTAL THROUGH THE LITCHFIELD COMPANY, ARRANGED BY AND THROUGH YOU, EXPRESSLY ASSUME THE SAME.
Deposit and Payment Due Date:
- An advance deposit equal to the first night's stay will be taken upon booking for all vacation guests.
- Your reservation’s remaining balance is due at time of check-in.
- A deposit of $100.00 per person will be taken upon booking for all golf packages. Final payments for all golf package reservations are due 14 days prior to the arrival date of the stay and play package.
- A valid photo I.D., as well as the credit card used to pay your deposit, will be required at check-in.
Methods of Payment:
Personal checks (that have fifteen (15) days to clear your bank), money orders, MasterCard, Visa, and Discover Card. Credit cards are excluded as methods of payment for monthly stays.
All reservations must be paid in full 1 Week prior to arrival. Please note that the card on file as designated by guest will be charged the full reservation balance 7 days prior to arrival. The guest authorizes this automatic charge unless the balance is paid more than 7 days prior to arrival.
Cancellation of Reservation:
- The advance deposit is 100% refundable if a reservation is canceled up to 14 days prior to the scheduled arrival date.
- Reservations canceled within 14 days of the arrival date can reallocate the advance deposit funds toward future dates within one year of the original stay dates. Please note that changes to the reservation will be subject to availability and any room rate differences.
- Guests who do not arrive on their scheduled arrival date and fail to notify the resort of a change to their stay dates, therefore acknowledge forfeiture of advance deposit funds.
- For Monthly Rentals Only: All deposits are due at the time of booking. Full amount of the deposit is non-refundable. No changes to the dates of arrival are permitted within 30 days of arrival. Payment of full stay is required upon check in. There will be absolutely no refunds on early departures. Additional requirements for winter rentals do apply.
Immediately notify the rental office of any missing or inoperative furnishings or equipment or any weak or unsafe conditions which may result in injury. Occupancy by you and/or your party shall be conclusive evidence that the unit is in satisfactory condition. During your stay, please promptly report any problems to our office so that our maintenance department might attend to them efficiently for your safety and comfort, and for that of future guests.
Condominium parking is limited:
Parking is limited to a maximum of two (2) automobiles per unit. Some units have one (1) automobile space per unit. Parking of campers, boats, trailers, or commercial vehicles is strictly prohibited. Motorcycles are prohibited on most BV properties.
The unit includes:
All furnishings required for normal living conditions. Rates include departure maid service & optional setup of linens. Linens are provided based on the number of paid occupants (monthly stays excluded). Pillows, bedspreads, and blankets are provided; however, these are for use as bedding on the beds only! You must bring your own blankets and towels for use on the beach, on the balcony, by the pool, etc. Units are set up for light housekeeping, including cooking and eating utensils.
Should a house party (chaperoned or un-chaperoned) occur, occupancy will be immediately terminated. Should a parent check into a rental and later leave students or minors, the students/minors will be evicted if we find it necessary to do so. No refund, including unused rental amounts, will be refunded.
Many homeowners have their personal property locked in a closet for their convenience. These areas are absolutely not included in this rental.
Two (2) keys shall be issued to you at check-in. There will be a $25.00 deduction from your security deposit for each key not returned to our office at departure.
In the event that an owner of a vacation rental unit elects to remove his/her property from our rental management responsibility, we will provide comparable accommodations or grant a full refund. We reserve the right to substitute suitable accommodations if circumstances require.
We cannot guarantee air conditioning or appliances. There will be no refund upon their failure. We try to keep these units in good working order. Our best will be done to have any malfunction repaired as quickly as possible.
Agent / Maintenance:
Personnel are permitted to enter premises during normal working hours (8:00am-6:00pm) for the purpose of conducting necessary repairs and/or maintenance.
After Hours Lock-outs:
There is a $65.00 charge for all after hours lock out calls. The tenant will meet an agent at our office and pay upon arrival.
Do Not Disturb:
Your Health and Safety is of utmost importance, therefore, if the "Do Not Disturb" sign remains on your door for an extended period-of-time and we are unable to contact you, we may knock on your door and if no answer, enter your room to determine your well-being. Please understand it is not our intention to disturb guests during their vacation, however, we reserve the right to enter rooms to check on the safety and security of our guests and property as well as to perform maintenance and repairs.
Litchfield Vacations, LLC, as agent, or the owner of the individual villa rented, shall not be liable for any damages or injury to the tenant or to any other person, or damages to any property occurring on the premises or any part thereof, or in common areas thereof, and tenant agrees to hold the agent and owners harmless for any claims of damages, no matter how caused. The agent will not be held responsible for acts of theft, vandalism, or other damage to the guest's personal property or vehicle.
By accepting this rental agreement as the guest, you agree to be responsible for any damage to the dwelling or grounds and to the furnishings which occur during your stay though act or negligence of you, your family, friends, or social guests, and adhere to all rules and regulations governing the property you occupy. You agree to surrender the property at the time and date specified in as good condition as it was at the beginning of your stay, except for reasonable wear and tear, act of God, and/or causes over which you have no control. If the unit is not left in satisfactory condition, you will be charged for repair and restoration to satisfactory condition, plus lost rents.The guest certifies that he/she is at least 21 years of age. Photo Id required at Check-in.
The guest certifies that he/she has read carefully the limitations on this villa by the owner and the agent as set forth in this agreement, including limitations on the number of persons permitted to occupy this villa and fully agrees to abide by such limitations.
